<p>For more conservative investors, the Healthcare REIT market can offer relative safety and stability.  During the height of the credit crisis, many REITs traded down by as much as 60% or more, yet most Healthcare REITs saw losses of only 10-15% and maintained their dividends.  If you want real estate exposure but also like to sleep at night, then a Healthcare REIT is definitely worth considering.</p>

The reason is that to the extent these funds invest in REITs, the underlying REITs pay out capital gains distributions which then must flow through to the fund investor. <p>In the meantime, the market is getting crowded. According to Bank of Montreal, there were 44 non-traded REITs operating as of September 2008. As of the end of 2009, there were another $19 billion in non-traded REITs in registration, and nearly $2 billion in still more registrations had been announced as of early 2010.</p>
<p>Non-traded REITs are a unique breed of REIT that investors should investigate carefully before signing any subscription agreements. Many (but not all) REIT dividends in this space are being paid from borrowings and capital &#8211; not funds from operations. This is obviously no bueno. This list includes working links to the home page of each REIT, current yields vs. offering yields and current redemption policies, all of which are critical elements in evaluating any investment.</p>

<div align="justify">The reason: the only thing these stock dividends represent in the short-term is a tax liability with almost no cash. You will still be obligated to pay taxes on the &#8220;income&#8221;. In the fourth quarter, Vornado and Northstar have elected to pay out just enough cash (40%) to cover your federal nut, but that&#8217;s small comfort if you need your dividends to pay the rent. For the first quarter of 2009, Northstar declared an all cash dividend. I still love Northstar, but if you&#8217;re in it for the dividends, it&#8217;s caveat emptor for these REIT stocks:</p>

<div align="justify"><span style="FONT-STYLE: italic;font-size:85%;" >** Anthracite has signaled its intention to pay 90% of its dividends in stock</span><span style="FONT-STYLE: italic;font-size:85%;" > (it is unclear what effect AHRs recent settlement with its secured/unsecured lenders will have on this)</span><span style="FONT-STYLE: italic;font-size:85%;" >, but has not yet declared such a dividend. Diamond Rock and RAIT Financial have done the same, but the splits remain unclear. Northstar paid a 60% stock dividend in Q4, but paid an all cash dividend in Q1. in Q1 2009, LXP reduced the amount of dividends paid in stock from 90% to 10%, but at the same time they cut their dividend by 45% . HPT eliminated its dividend in Q1 but said it intends to pay a dividend in Q4, and that it may include both cash and stock. CBL announced in Q1 that it would resume its cash dividend in Q2.</span></p>
<p><p>
With these stock dividends, REITs are able to preserve <span style="font-size:78%;">prolong the agony</span> REIT status and cash in the hopes that the capital markets will someday become viable funding sources again. Clearly however, investors are betting that some REITs&#8217; ability to pay cash dividends on the IOUs they are now distributing is about as likely as the W being voted back into office.</p>
<p>Unfortunately, I can&#8217;t imagine any capital-starved REIT not electing to take advantage of this revenue ruling (at least to some extent). Undoubtedly, this will further erode confidence in the sector and prolong the recovery in REITs.</p>

<p>This REIT ETF directory is also a good place to start if you want to short commercial real estate.  Be cautious shorting these ETFs however, as commercial real estate is notoriously cyclical. Since hitting their lows in March of 2009, many of these ETFs experienced strong positive returns for the year, while <span style="color: rgb(0, 0, 255);"><span id="ticker">SRS</span></span> was down 90%.</p>
<p>For risk-tolerant investors, Direxion recently launched a brand new pair of REIT ETFs, <span style="color: rgb(0, 0, 255);"><span id="ticker">DRN</span></span> and <span style="color: rgb(0, 0, 255);"><span id="ticker">DRV</span></span>, which provide broad, leveraged exposure to the MSCI U.S. REIT Index.   DRN will seek to provide 300% long exposure to the index, while DRV will provide 3x inverse (short) exposure to the same index.  Each comes complete with an expense ratio of 0.95%.</p>

Note: I have not included <span style="color: rgb(0, 0, 255);"><span id="ticker">(DRW)</span></span>, <span style="color: rgb(0, 0, 255);"><span id="ticker">(IYR)</span></span>, <span style="color: rgb(0, 0, 255);"><span id="ticker">(SRS)</span></span>, <span style="color: rgb(0, 0, 255);"><span id="ticker">(URE)</span></span>, or <span style="color: rgb(0, 0, 255);"><span id="ticker">(WPS)</span></span> in this list, as neither is technically a REIT ETF. These ETFs cast a slightly wider net and include real estate services firms and real estate operating companies that are not organized as REITs.</p>
<p><p>
Two other interesting tools to make the housing/real estate play began trading in mid-2009: The MacroShares Major Metro Housing Down ETF (NYSEArca:<span style="color: rgb(0, 0, 255);"> <span id="ticker">DMM</span></span>); with 1.25% annual fees, and The MacroShares Major Metro Housing Up ETF (NYSEArca:<span style="color: rgb(0, 0, 255);"> <span id="ticker">UMM</span></span>); also with 1.25% annual fees.</p>
<p>Investors should be also aware of the PowerShares Dynamic Building &amp; Construction Portfolio ETF (AMEX:<span style="color: rgb(0, 0, 255);"> <span id="ticker">PKB</span></span>), which contains mostly firms serving the housing industry. No actual builders are included.</p>
<p>One caveat: REIT ETFs don&#8217;t necessarily have the same tax efficiency benefit as other ETFs. The reason is that the underlying REITs pay out capital gains distributions which then must flow through to the ETF investor. For that reason, check into when the capital gains get distributed and check with your tax advisor before investing.
